PROPER PURPOSE - REQUEST FOR A COPY OR INSPECTION OF A SHARE REGISTER

The ICSA has published new guidance on the proper purpose test which is required for the inspection of a register of members. Recent case law has driven the need for an update and whilst the courts have yet to provide firm guidance, instead favouring a view on a case by case basis, the guidance and procedure will nonetheless provide the courts the baseline on which to find a case.
